1. Eligibility and Acceptance

By accessing or using EKATRACORE services, you confirm that you are legally competent to enter into a binding contract under applicable law. If you use the service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

Use of the service signifies acceptance of these Terms, the Privacy Policy, and the Cancellation / Refund Policy. If you do not agree, you must discontinue use immediately.

2. Account Responsibilities

You are responsible for maintaining accurate account information, safeguarding credentials, and controlling account access. You must immediately report unauthorized use, suspected compromise, or account anomalies through official support channels.

• Provide true and up-to-date registration and billing details.
• Maintain confidentiality of passwords, authentication factors, and API credentials.
• Accept responsibility for all activities performed through your account, whether authorized by you or not.
• Use only one account identity per legal user unless explicitly permitted in writing.

3. Fees, Billing, and Taxes

Fees for paid plans are disclosed during checkout or plan activation and may include recurring charges for subscription periods. By subscribing, you authorize applicable recurring billing unless canceled in accordance with policy terms.

• All prices are subject to applicable taxes, levies, and statutory deductions.
• You are responsible for any GST, VAT, withholding, or similar taxes applicable to your use.
• Failed, reversed, or disputed payments may result in service restriction until account settlement.
• Refund and cancellation eligibility is governed by the dedicated refund policy.

4. Acceptable Use and Service Conduct

You agree to use the service only for lawful and legitimate business purposes. Prohibited conduct includes abuse of platform integrity, unauthorized access, and rights-violating activity.

• Do not introduce malware, malicious scripts, or denial-of-service activity.
• Do not scrape, harvest, or exfiltrate data beyond authorized use.
• Do not impersonate individuals, entities, or misrepresent affiliation.
• Do not use the platform for fraudulent, defamatory, infringing, or unlawful acts.

5. Intellectual Property and License

All rights, title, and interest in EKATRACORE software, interfaces, branding, documentation, and underlying workflows remain with the proprietor or authorized licensors. Subject to these Terms, users are granted a limited, revocable, non-exclusive, non-transferable right to access and use the service.

You may not reproduce, distribute, reverse engineer, decompile, create derivative works, or commercially exploit protected platform assets except as permitted by law or explicit written authorization.

6. Warranty Disclaimer, Limitation of Liability, and Indemnity

Services are provided on an "as is" and "as available" basis. EKATRACORE does not warrant uninterrupted availability, error-free operation, or fitness for a specific user objective.

Limitation of Liability

To the maximum extent permitted by law, EKATRACORE is not liable for indirect, consequential, punitive, incidental, or special damages. Aggregate liability for any verified claim is limited to the amount paid by you for the affected paid service during the preceding one billing cycle.

Indemnity

You agree to indemnify and hold harmless EKATRACORE and the sole proprietor from losses, claims, liabilities, penalties, and costs arising from your misuse of the platform, breach of these Terms, violation of law, or infringement of third-party rights.

7. Suspension and Termination

EKATRACORE may suspend or terminate access without prior notice where reasonably required for security risk, policy breach, legal compliance, fraudulent behavior, payment default, or system integrity protection.

Upon termination, access rights cease immediately. Retention and deletion of account data are handled according to legal obligations, operational needs, and the Privacy Policy.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Parties shall first attempt good-faith resolution through written notice and direct communication.

If unresolved, disputes shall be subject to the competent courts at the proprietor's principal place of business in India, unless otherwise required by mandatory law.

9. Updates to These Terms

We may revise these Terms to reflect legal, operational, product, or compliance requirements. Revised terms become effective upon publication with an updated "Last Updated" date.

Continued use of the service after publication of revisions constitutes acceptance of the updated Terms.

10. AI-Assisted Outputs and Manual Verification

EKATRACORE may use AI-assisted background support to help generate, classify, summarize, format, or review reports and workflow outputs. AI-assisted outputs may contain errors, omissions, hallucinated statements, outdated assumptions, inaccurate calculations, or incorrect reports.

Reports and AI-assisted outputs are decision-support tools only. They are not, by themselves, final investment advice, legal advice, tax advice, regulatory advice, or a substitute for professional judgment.

SEBI registered Research Analysts, authorized users, and any professional user must independently verify all source data, calculations, assumptions, suitability considerations, disclosures, conclusions, and final report language before relying on, publishing, sharing, or presenting any output to a client, investor, or third party.

Human review and manual validation are mandatory before any client-facing, investor-facing, regulatory, or commercial use. Users remain responsible for regulatory compliance, recordkeeping, required disclosures, professional judgment, and adherence to applicable SEBI Research Analyst regulations, circulars, and guidance.

EKATRACORE does not guarantee accuracy, completeness, regulatory sufficiency, investment performance, suitability, or error-free operation of AI-assisted outputs. Users should consult qualified compliance, legal, tax, or SEBI regulatory professionals where appropriate.

11. Regulatory Position Clarification

EKATRACORE is operated as a sole proprietorship and does not claim brokerage, investment advisory, payment-banking, or securities regulatory registration unless expressly published through an official legal disclosure.
